Commission publishes decision on matters referred to it by the 2008 Aviation Appeal Panel

The Commission has published its decision on review of the matters referred back to it by the 2008 Aviation Appeal Panel ('the Panel').  The Commission's decision is to affirm its determination on the price cap, which runs to 31 December 2009.  Click here to download a copy of the Commission's decision on the 2008 Appeal Panel.

Background to the 2008 Aviation Appeal Panel

In September 2008, the Minister for Transport, on foot of requests from a number of parties, convened an Aviation Appeal Panel to consider the Commission's July 2007 final decision on the interim review of the price cap at Dublin airport.

The Panel heard four separate appeals from Aer Lingus, DAA, the Dublin Airport Consultation Committee and Ryanair. On 23 December 2008, the Panel published four separate decisions relating to each of these appeals.  From this date, the Commission had a statutory deadline of two months by which to reach its final decision on review of matters referred back to it by the Panel.  All of the materials relating to the Panel's decisions, including the specific matters referred back to the Commission, are published on the Commission's website.

Summary of the Commission's decision

The Commission has decided to affirm its July 2007 decision with regard to the cap on average revenue per passenger at Dublin airport over the 2006 to 2009 period.  The July 2007 decision, which itself did not change the price cap set in September 2005, allowed for average revenue per passenger at Dublin airport to change annually by the rate of inflation (CPI) plus 4%.  In 2009, the cap on average revenue per passenger at Dublin Airport is €7.39.
